Terms of Use
These terms apply when you use the PhaseStrong app. We kept them short. If the language versions differ, the one more favorable to you applies.
Who we are
PhaseStrong is offered by Andre Luiz Ferreira De Jesus Filho, a private individual (not a company) based in North Carolina, USA — Troutman, NC 28166, United States. "We" and "us" in these terms mean Andre Luiz Ferreira De Jesus Filho.
What PhaseStrong is
An app for strength training and nutrition that adapts to your cycle and life stage. The free features work without a subscription; a subscription unlocks the premium features. There is no PhaseStrong account and no server of ours: the app runs on your phone.
Wellness, not medicine
PhaseStrong is a general wellness and fitness app. It is not a medical device and does not give medical advice, diagnosis or treatment. It does not predict fertile days or ovulation and must not be used for contraception or to plan a pregnancy. Talk to a doctor before starting a new training or nutrition plan — especially if you are pregnant, postpartum, have a health condition or take medication. Stop exercising and get help if you feel pain, dizziness, chest pain or shortness of breath, or feel unwell. The app's plans are suggestions: you decide what is right for your body.
Age
You must be at least 15 to use PhaseStrong. If you are 15, 16 or 17, you may use the app and subscribe only with the permission of a parent or legal guardian, who also agrees to these terms.
Subscriptions
Subscriptions are sold and billed by Apple (App Store) or Google (Google Play), not by us. Before you buy, the store shows the price with any taxes; it charges your store account and renews the subscription automatically at the end of each period until you cancel (on the App Store, at least 24 hours before the period ends). Free trials, price changes, cancellation and refunds follow the store's rules. You can cancel at any time in your phone's subscription settings — in the app, Settings → Account & subscription takes you there — and you keep premium until the end of the period you paid for. Refunds are requested from the store (Apple: reportaproblem.apple.com; Google: Google Play); we cannot refund store purchases ourselves. Deleting the app does not cancel a subscription.
Your data
What you log stays on your phone; we have no server and no copy, so we cannot see, sell or share it. Your phone's own backup can keep an encrypted copy in your own Apple or Google account (on by default; you can turn it off in the app). Because we have no copy, we cannot recover lost data for you: keep that backup on or export an encrypted backup file. The Privacy policy and the Consumer Health Data Privacy Policy explain the details.
Your license to use the app
We give you a personal, non-exclusive, non-transferable license to use PhaseStrong on devices you own or control, for your own non-commercial use, under these terms and the store's rules. If you got the app from the App Store, Apple's standard license terms (EULA) also apply. The app and its content — texts, workouts, illustrations and voice — remain ours or our licensors'. Do not copy, resell, modify or reverse-engineer the app, except where the law allows it.
AI-generated content
Some illustrations and the coach's voice in the app are generated with artificial intelligence (AI). The app does not use AI to make decisions about you; its plans are suggestions you can always change.
Liability
We work to keep the app correct and available, but we provide it "as is" and cannot promise it will always be error-free or available. To the extent the law allows, we are not liable for indirect or unforeseeable damage, and our total liability is limited to what you paid for PhaseStrong in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law — for example for intent, gross negligence, fraud, or injury to life, body or health — or takes away your statutory consumer rights.
Changes to these terms
We may update these terms for legal, technical or product reasons. The app shows the date of the current version, and we announce important changes in the app before they take effect. If you do not agree, you can stop using the app and cancel your subscription in the store.
Governing law
These terms are governed by the laws of the State of North Carolina, USA, and disputes go to the state or federal courts in North Carolina. This does not take away the protection of the mandatory laws of the country or state where you live: you can still rely on them and, where your law allows, go to court where you live.
